1. Binding Agreement and Acceptance
1.1 Legal Agreement
These Terms of Service ("Terms"), together with our Privacy Policy and any additional terms provided, constitute a binding legal agreement ("Agreement") between you and Performance Hub, Inc. ("Company," "we," "us," or "our") governing your use of our mobile application, website, and related services (collectively, the "Service").
By accessing, downloading, installing, or using Performance Hub in any way, you:
- Agree to be legally bound by this entire Agreement
- Acknowledge you have read and understand all terms
- Confirm you have authority to enter into this Agreement
- Represent that you are at least 18 years old (or have parental consent)
If you do not agree to ANY provision of this Agreement:
- Do not use Performance Hub
- Delete the application from your device
- You have no license to use the Service
1.2 Modification of Terms
We may modify these Terms at any time. Material changes will be announced with 30 days notice. Continued use of the Service after changes constitutes acceptance. We will notify you via email or in-app notification of material changes.
2. Service Overview
2.1 What We Provide
- Fitness and training program recommendations
- Health metrics and biomarker analysis and insights
- Nutrition and supplement tracking (including controlled substances for harm reduction)
- Harm reduction educational information and safety warnings
- Recovery and strain monitoring
- Integration with wearable devices
- Personalized coaching and recommendations
- Mobile app and web portal
- Customer support
2.2 What We Do NOT Provide
Performance Hub does NOT provide:
- Medical diagnosis or treatment
- Medical advice or professional medical guidance
- Healthcare services
- Psychiatric or mental health treatment
- Legal or financial advice
- Licensed coaching (community/educational information only)
- Prescription management or authorization
- Verification of supplement legality, purity, safety, or efficacy
- Approval or encouragement of controlled substance use
- Substitutes for medical supervision of performance-enhancing drugs
2.3 Harm Reduction Supplement Tracking
🛡️ Harm Reduction Approach:
Our mobile app includes supplement tracking with harm reduction education to help users make informed decisions and reduce health risks.
- Purpose: Provide educational safety information, not encourage illegal activity
- Your Responsibility: You are solely responsible for legal compliance and safety of substances you use
- Logging: All entries logged with timestamps and IP addresses for legal compliance
- Law Enforcement: We will cooperate with legal requests and may share your data if required by law
- No Liability: We are NOT liable for health consequences or legal issues from your substance use
2.4 Service Availability
We aim for 99.5% uptime but provide no guaranteed uptime. Service may be unavailable for maintenance. We provide "as-is" without warranties and features may change or be discontinued.
3. User Accounts and Registration
3.1 Account Creation
To create an account, you must:
- Be 18 years or older
- Provide accurate information
- Use a valid email address
- Create a secure password
- Accept all Terms and Privacy Policy
- Be capable of entering binding contracts
3.2 Account Security
You are responsible for:
- Accuracy of all information you provide
- Maintaining confidentiality of password
- All activity under your account
- Notifying us of unauthorized access
- Logging out on shared devices
3.3 Account Termination
You may delete your account in Settings → Account → Delete Account. We may terminate accounts for violation of Terms, illegal activity, abuse, fraud, non-payment, or inactivity (12+ months). Upon termination, all access ends immediately and no refunds are issued.
4. Subscription and Payment Terms
4.1 Subscription Tiers
Free Tier:
- Limited features and metrics
- Basic program recommendations
- No payment required, no auto-renewal
Premium Tier:
- Full feature access
- Advanced analytics and insights
- Personalized coaching
- Monthly or annual billing with auto-renewal
4.2 Billing and Auto-Renewal
Subscriptions renew automatically on billing date. Payment is charged to your payment method on file. Renewal emails are sent 5 days before billing date. Failed payments trigger retry attempts (3-4 over 7 days) and account access may be suspended if unpaid.
4.3 Cancellation and Refunds
Cancel anytime in Settings → Subscription → Manage Subscription. Cancellation is effective at end of current billing period. You retain access through end of paid period. No refunds for partial months/years or voluntary cancellations.
Refunds may be provided for billing errors (within 30 days) or where required by law. Contact billing@performancehub.app for refund requests.
5. License and Restrictions
5.1 Limited License
You are granted a limited, non-exclusive, revocable license to download, install, and use Performance Hub for personal, non-commercial purposes in accordance with these Terms.
5.2 Restrictions
You must NOT:
- Copy, modify, or create derivative works
- Reverse engineer, decompile, or disassemble
- Distribute, sell, rent, lease, or lend the app
- Use for commercial purposes or competing platforms
- Scrape or extract data in bulk
- Automate access or use bots
- Interfere with service functionality
- Violate any laws or regulations
- Harass, abuse, or threaten other users
5.3 Intellectual Property
We own all code, algorithms, technology, graphics, designs, content, and trademarks. You own your personal information (subject to license), content you create, and your workout logs. By using the Service, you grant us a worldwide, royalty-free license to use your content for service improvement and optimization.
6. User Conduct
You agree to use Performance Hub:
- In compliance with all applicable laws in your jurisdiction
- Respectfully toward other users
- Without sharing false or misleading information
- Without attempting to access other users' accounts
- Without interfering with the Service's operation
- Taking sole responsibility for your training, supplement, and health decisions
- Verifying legality of substances you track in your jurisdiction
- Obtaining medical supervision for controlled substances
- Not using the service to facilitate illegal drug distribution
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERFORMANCE HUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
WE ARE NOT LIABLE FOR: Deaths, injuries, illnesses, or adverse health effects from substances you track or use; drug interactions, overdoses, or toxicity; legal consequences from controlled or illegal substances; inaccurate biomarker analysis; reliance on harm reduction information; or contaminated/counterfeit substances obtained independently.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS LESS.
8. Indemnification
You agree to indemnify and hold harmless Performance Payments from any claims, damages, losses, and expenses (including attorney fees) arising from:
- Your use of controlled substances, illegal substances, or performance-enhancing drugs
- Your violation of laws regarding substance possession, use, or distribution
- Health consequences from substances you track in the app
- Third-party claims related to your substance use
- Your violation of these Terms of Service
- Your violation of any applicable laws
